Supplements: MEMORANDUM REGARDING 52 CASTLE ST. & CASTLE LANE 1. ZONING: The property (both parcels) is within the I-2 zone. Some uses are by-right & others require special permits or other requirements through the town. Consultation required with a competent site professional and the town to understand what is possible. 2. WETLANDS: A Notice of Intent was filed around 2008 to allow for the repair of a Town drainage structure on the property. Ultimately, a Superseding Order of Conditions was issued by Mass.DEP and the work done. A Certificate of Compliance was recently issued and will be filed in the Registry of Deeds. Any additional project that proposes work adjacent to the wetlands may require filing with the local Conservation Commission. 3. CHAPTER 54-A: Under state law, any building permit filed with the town, AND on lands formerly railroad rights of way, must request that the Town Building Inspector file a form with Mass.DOT for their review. There was an amendment to this law in 2018 that apparently makes it simpler. Our building a 50 Castle Street was built after such a filing. We do not claim to be offering legal opinions in this Memorandum, but merely attempting to offer some initial guidance. There may be uses that do not require any over-site by the Town or the State.
